Randy Resh was found not guilty this morning in his retrial for a 1988 murder.
The Ohio Supreme Court overturned the 43-year-old's Shalersville man's conviction last December on the grounds that his defense lawyer failed him in 1990. He has been imprisoned for 16 years.
Emotions erupted in the packed courtroom as the verdict was announced. The jury has been deliberating the case since Monday.
The case against Resh hinged almost entirely on whether the jurors could believe what one-time co-defendant Troy Busta says Resh did. Busta, a 38-year-old from Hiram, pleaded guilty in 1989 to taking part in the murder and attempted rape of Connie Nardi, a young mother of two.
Busta, then 21, confessed, striking a plea deal in which the state dropped its pursuit of a death sentence in return for Busta implicating Resh and another man named Robert "Robie" Gondor as other perpetrators.
